			<content:encoded><![CDATA[<p><strong></strong>In 2011 the government undertook a pledge to businesses to cut red tape and simplify the law in relation to employment and human resources. Consultation with interested parties was issued generally through websites with the employment law areas concentrating on four main topics: compliance and enforcements, letting people go, managing staff, and taking people on. Contributions came from wide range of parties including the Employment Lawyers Association, Federation of Small Businesses and the Confederation of British Industry. As a response new legislation was proposed and will now be introduced from the 6th April 2012.</p>
<p>Stuart Atherton of Peter Lynn and Partners answers some key questions and explains how this new legislation affects employers and employees:</p>
<p><strong>What is the difference between a worker and an employee and how does it affect their employment rights?</strong></p>
<p>“The first thing to remember is there is a clear difference between a “worker” and an “employee”. In employment a volunteer worker without a contract would be entitled to certain claimant rights such as holidays and national minimum wage, but they could never claim for unfair dismissal or redundancy, because their circumstances would not be recognised by any employment tribunal. However, an employee with a contract of employment would be able to claim more extensive employment protection rights under the current law including unfair dismissal, as long as they could prove that they had been in continuous employment for 12 months in the case of unfair dismissal.”</p>
<p><strong>Is the law regarding continuous employment for Unfair Dismissal going to change?</strong></p>
<p>“Yes, from the 6th April 2012 the law will change from 12 months to 24 months. It now means that the employee will have to prove that they have been in continuous employment for 24 months before any claim for unfair dismissal can be made to any tribunal.</p>
<p>In theory this now makes it more appealing for employers to recruit staff, as there is an extra 12 months cushion in place to allow employees to gel into the work place and do the job effectively. From an employer’s perspective they do not face the risk of being challenged for unfair dismissal if the employee’s contract is terminated before a 24 month period of continuous employment.”</p>
<p><strong>Is there a fee or a court cost to an employee who presents a complaint to the employment tribunal?</strong></p>
<p>“Under the current law there is no fee for the claimant, but this will be changing. Whilst a date has yet to be fixed, it is widely expected that fees of between £200-£1750 for issuing claims will be introduced possibly from April 2013. I see this as good for business simply because it filters out those non-genuine claims where maybe malice as opposed to justice is the motive. In any instance the employer has to defend a claim or risk a default of judgment, hence incurring costs. The new law at least puts some responsibility on the claimant to think before they act as the initial claimant’s fee could exceed £1,000.00”.</p>
<p><strong>Why are there so many changes to Employment Law and are there any recent examples of good legislation?</strong></p>
<p>“The Law is always changing, but there is always a reason for any change. This current legislation is designed to simply cut through the red tape and make it more attractive for employers to take on staff, hence creating employment opportunities whilst providing fair employment rights to employees in return.</p>
<p>A recent example of good legislation is the Equality Act introduced in October 2010 and now working extremely well, making the law clearer to both employers and employees. This effectively is a Consolidating Act which combines issues on Race, Disability and Sex (as well as other areas) into a piece of legislation which is simpler to understand and easier to manage.</p>
<p>Despite the explanations how is a typical SME without a dedicated HR function supposed to keep on top of the changes in the law and manage their business?</p>
<p>It’s a good question and without the right support it’s very difficult for an employer to keep on top of all of the legal requirements. Running a business on a day to day basis is hard enough for any business owner, without the added worry of complex legal issues and potential legal challenges thrown up by employees.</p>
<p>As a firm of legal specialists we recognise this problem, hence the introduction of the bespoke “Guardian Scheme” specifically tailored for SME’s employing below 250 people. The Guardian scheme is quite unique and is designed to make the business stronger and save the business owner money.</p>
<p>It provides an array of business solutions to complex subjects such as recruitment, employment contracts, HR training and claims. &gt; It&#8217;s time again for the annual &#8216;Stella Awards&#8217;! For those<br />
&gt; unfamiliar with these awards, they are named after 81-year-old Stella<br />
&gt; Liebeck who spilled hot coffee on herself and successfully sued the<br />
&gt; McDonald&#8217;s in New Mexico , where she purchased coffee. You remember,<br />
&gt; she took the lid off the coffee and put it between her knees while she<br />
&gt; was driving. Who would ever think one could get burned doing that,<br />
&gt; right? That&#8217;s right; these are awards for the most outlandish lawsuits<br />
&gt; and verdicts in the U.S. You know, the kinds of cases that make you<br />
&gt; scratch your head. So keep your head scratcher handy.<br />
&gt;<br />
&gt; Here are the Stellas for year &#8212; 2011:<br />
&gt;<br />
&gt; * SEVENTH PLACE *<br />
&gt;<br />
&gt; Kathleen Robertson of Austin, Texas was awarded $80,000 by a<br />
&gt; jury of her peers after breaking her ankle tripping over a toddler who<br />
&gt; was running inside a furniture store. The store owners were<br />
&gt; understandably surprised by the verdict, considering the running<br />
&gt; toddler was her own son<br />
&gt;<br />
&gt; Start scratching!<br />
&gt;<br />
&gt; * SIXTH PLACE *<br />
&gt;<br />
&gt; Carl Truman, 19, of Los Angeles , California won $74,000 plus<br />
&gt; medical expenses when his neighbor ran over his hand with a Honda<br />
&gt; Accord. Truman apparently didn&#8217;t notice there was someone at the wheel<br />
&gt; of the car when he was trying to steal his neighbor&#8217;s hubcaps.<br />
&gt;<br />
&gt; Scratch some more&#8230;<br />
&gt;<br />
&gt; * FIFTH PLACE *<br />
&gt;<br />
&gt; Terrence Dickson, of Bristol , Pennsylvania , who was leaving a<br />
&gt; house he had just burglarized by way of the garage. Unfortunately for<br />
&gt; Dickson, the automatic garage door opener malfunctioned and he could<br />
&gt; not get the garage door to open. Worse, he couldn&#8217;t re-enter the house<br />
&gt; because the door connecting the garage to the house locked when<br />
&gt; Dickson pulled it shut. Forced to sit for eight, count &#8216;em, EIGHT days<br />
&gt; and survive on a case of Pepsi and a large bag of dry dog food, he<br />
&gt; sued the homeowner&#8217;s insurance company claiming undue mental Anguish.<br />
&gt; Amazingly, the jury said the insurance company must pay Dickson<br />
&gt; $500,000 for his anguish. We should all have this kind of anguish Keep<br />
&gt; scratching. There are more&#8230;<br />
&gt;<br />
&gt; Double hand scratching after this one..<br />
&gt;<br />
&gt; *FOURTH PLACE*<br />
&gt;<br />
&gt; Jerry Williams, of Little Rock, Arkansas, garnered 4th Place in<br />
&gt; the Stella&#8217;s when he was awarded $14,500 plus medical expenses after<br />
&gt; being bitten on the butt by his next door neighbor&#8217;s beagle &#8211; even<br />
&gt; though the beagle was on a chain in its owner&#8217;s fenced yard. Williams<br />
&gt; did not get as much as he asked for because the jury believed the<br />
&gt; beagle might have been provoked at the time of the butt bite because<br />
&gt; Williams had climbed over the fence into the yard and repeatedly shot<br />
&gt; the dog with a pellet gun.<br />
&gt;<br />
&gt; Pick a new spot to scratch, you&#8217;re getting a bald spot..<br />
&gt;<br />
&gt; * THIRD PLACE *<br />
&gt;<br />
&gt; Amber Carson of Lancaster, Pennsylvania because a jury ordered a<br />
&gt; Philadelphia restaurant to pay her $113,500 after she slipped on a<br />
&gt; spilled soft drink and broke her tailbone. The reason the soft drink<br />
&gt; was on the floor: Ms. Carson had thrown it at her boyfriend 30 seconds<br />
&gt; earlier during an argument. What ever happened to people being<br />
&gt; responsible for their own actions?<br />
&gt;<br />
&gt; Only two more so ease up on the scratching&#8230;<br />
&gt;<br />
&gt; *SECOND PLACE*<br />
&gt;<br />
&gt; Kara Walton, of Claymont , Delaware sued the owner of a night<br />
&gt; club in a nearby city because she fell from the bathroom window to the<br />
&gt; floor, knocking out her two front teeth. Even though Ms. Walton was<br />
&gt; trying to sneak through the ladies room window to avoid paying the<br />
&gt; $3.50 cover charge, the jury said the night club had to pay her<br />
&gt; $12,000&#8230;.oh, yeah, plus dental expenses. Go figure.<br />
&gt;<br />
&gt; Ok. Here we go!!<br />
&gt;<br />
&gt; * FIRST PLACE *<br />
&gt;<br />
&gt; This year&#8217;s runaway First Place Stella Award winner was: Mrs.<br />
&gt; Merv Grazinski, of Oklahoma City, Oklahoma, who purchased new 32-foot<br />
&gt; Winnebago motor home. On her first trip home, from an OU football<br />
&gt; game, having driven on to the freeway, she set the cruise control at<br />
&gt; 70 mph and calmly left the driver&#8217;s seat to go to the back of the<br />
&gt; Winnebago to make herself a sandwich. Not surprisingly, the motor home<br />
&gt; left the freeway, crashed and overturned. Also not surprisingly, Mrs.<br />
&gt; Grazinski sued Winnebago for not putting in the owner&#8217;s manual that<br />
&gt; she couldn&#8217;t actually leave the driver&#8217;s seat while the cruise control<br />
&gt; was set. The Oklahoma jury awarded her, are you sitting down?<br />
&gt; $1,750,000 PLUS a new motor home. Winnebago actually changed<br />
&gt; their manuals as a result of this suit, just in case Mrs. Grazinski<br />
&gt; has any relatives who might also buy a motor home.<br />
&gt; If you think the court system is out of control, be sure to pass<br />
&gt; this one on.</div>

One of those includes Neath Pony Club. Catrin Stephens a Family Law Solicitor based at the SA1 Head Office is actively involved in the club.</p>

<p>Catrin is a keen horse rider and her two children compete regularly for Neath Pony Club in the Mounted Games category. The Pony Club is an International Voluntary Youth Organisation for young people interested in ponies and riding.  It currently has 50,000 young members in the UK.</p>

<p>At Neath Pony Club, members can receive instruction in show jumping, dressage, cross country showing and mounted games events.  The club has enjoyed a great deal of success in recent years competing at both local and national level.</p>
<p>In March 2012 two young riders Anna Lynch and Rebecca Jones will take part in The Welsh Mounted Games Trials at Builth Wells, where they hope to gain selection and go onto represent Wales at a major tournament.</p>
<p><strong>Profile:</strong></p>
<p>Catrin is a highly experienced solicitor specialising in family &amp; matrimonial law. Having graduated from Keele University in Staffordshire with a BA Hons in Law &amp; English, Catrin went on to study at the College of Law, Chester before  pursuing her chosen career path of becoming a solicitor. She joined Peter Lynn &amp; Partners in 2006. Catrin is an Accredited Member of The Law Society’s Family Law Panel and is an integral part of the Peter Lynn’s legal team at Swansea’s Head Office in Langdon House, SA1.</p>
<p>Family Law can be very emotive and Catrin understands the sensitivities associated with divorce, family disputes and residence and contact disputes over children. Catrin is also qualified as a family mediator.</p>

<p>Sara said, “At Peter Lynn &amp; Partners we can help you take control of your assets and assist you to prepare them in the event of a future separation so that if the worst happens matters can be dealt with swiftly and amicably – married or unmarried.</p>

<p>We asked Sara to explain how different the law is between Marital &amp; Cohabitee Disputes? Sara said: “It is estimated that there are more than two million cohabiting couples in England and Wales.  Cohabitee disputes are becoming increasingly common as couples choose to live together rather than entering marriage.</p>
<p>“Some people are under the misapprehension that once living together they are common law “husband and wife” and on separation are entitled to the same protection that they would have had, had they been married.  <strong><span style="text-decoration: underline;">This is not correct</span></strong>.”</p>
<p>A recent decision in the Supreme Court however,  has significant implications for the unmarried couple as it will allow the Court to consider the issue of ‘fairness’ if they are unable to firmly establish the parties intentions in respect of jointly owned property.</p>
<p>Sara explained the Case. “A couple Mr K and Ms J purchased a property jointly but separated some thirteen years later.  The couple had children and Ms J remained at the property with the children and maintained the mortgage solely for thirteen years.  Mr K then sought to realise his interest and the Court of Appeal ruled that Mr K was entitled to 50% of the value as the parties owned the property in equal shares.</p>
<p>“The Supreme Court took the view that in these circumstances an equal division was unfair and awarded Mr K 10% of the value of the home.</p>
<p>“This Judgement does promise more just outcomes for parties who have relatively few legal rights because they are unmarried.  It is essential that parties give consideration to what their intentions are during the period of their cohabitation to avoid incurring significant legal costs whilst any uncertainties are “battled” through the courts.  Parties should consider entering into Cohabitee Agreements setting out their agreed intentions.  Declarations of Trust can be drawn up at the time properties are purchased which can expressly stipulate who gets what in the event of a separation.</p>
<p>“All of our clients are at the very least entitled to a free half hour consultation to discuss their circumstances and we can undertake cases under the Legal Aid Scheme or on a privately paying basis. We try to prevent legal problems occurring; prevention is better than a cure.”</p>
